SB 1383 places limits to reduce methane emissions

SB 1383 places limitations on organic waste in landfills to reduce methane emissions. Governor Brown approved SB 1383 in September 2016, and I wanted to give everyone a quick update. Here are the highlights:

SB 1383 methane emission reduction goals aim to decrease the amount of organic materials disposed of in landfills, and include the following targets:

  • 50% reduction in the level of the statewide disposal of organic waste from 2014 levels by 2020;
  • 75% reduction in the level of statewide disposal of organic waste from 2014 levels by 2025; and
  • Not less than 20% percent of edible food that is currently disposed of is recovered for human consumption by 2025.

SB 1383 requires CalRecycle and California Air Resources Board to adopt regulations to achieve the organic waste reduction targets.  These regulations:

  • May require local jurisdictions to impose requirements on generators (e.g. businesses and residents) within their jurisdiction and may authorize local jurisdictions to impose penalties on generators for noncompliance.
  • May include different levels of requirements for local jurisdictions and phased timelines based upon their progress in meeting the organic waste reduction goals for 2020 and 2025.
  • May include penalties (up to $10,000 per day) to be imposed by CalRecycle on local jurisdictions for noncompliance.
  • Shall take effect on or after January 1, 2022, except the imposition of any penalties shall not take effect until two years after the effective date of the regulations.

SB 1383 authorizes local jurisdictions to charge and collect fees to recover the local jurisdiction’s costs incurred in complying with the organic waste reduction regulations.
